The Equal Employment Opportunity Commission (“EEOC”) is the government agency responsible for investigating allegations of discrimination and retaliation in the workplace. However, the agency is designed to investigate, not advocate for an employee’s rights. Therefore, it’s important to contact a Board Certified in Labor and Employment attorney to assist you in navigating the sometimes tricky EEOC process.

Before filing a federal lawsuit for discrimination or harassment against an employer, an employee must first file a Charge of Discrimination with the EEOC. Short deadlines apply to when an employee needs to file a Charge, so don’t delay.

After the claim is filed, the EEOC investigates the charge by asking both the employee and the employer being charged for documents and information relevant to the charge. The agency also offers a mediation program that the parties may use to attempt to resolve their dispute.
